Terms of Service
1. Who we are, and agreeing to these terms
nvlope is operated by Nvlope Technologies, Inc., a Delaware corporation ("nvlope," "we," "us"). These Terms of Service (the "Terms") govern your use of nvlope.com and everything we offer through it (the "Service"). By sending a gift, claiming one, creating an account, hosting an event or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
You must be at least 18 years old and able to enter into a binding contract to send or claim money through nvlope. Receiving a card is open to anyone; the money in it must be claimed by an adult.
2. What nvlope is
nvlope is a way to give a cash gift with a card. A sender designs a card (a message, handwriting, a photo or logo, a video or voice note), chooses an amount, and pays. The recipient opens the card from a link we deliver by email or text message, or printed inside a mailed card, and claims the money into their own bank account. Hosts can set up an event or registry that guests give to, and groups can pool contributions into one gift.
nvlope is not a bank, money transmitter or wallet. We never hold your money. Payments are processed by Stripe, Inc.; a gift is paid to Stripe and transferred to the recipient's own Stripe account when they claim it. Hosts and recipients open a Stripe Express account to receive funds and agree to the Stripe Connected Account Agreement and the Stripe Services Agreement. Stripe may ask them to verify their identity before money can be paid out, as any bank would.
3. Sending a gift
- Amounts. Gifts are from $5 to $5,000. Gifts paid by card or Apple Pay are capped at $250; larger gifts are paid from a bank account.
- What you pay. The gift amount, plus the price of the card. Your first nvlope card is free. After that a card is $2.99 during early access ($4.99 regular price); a printed, mailed card is $9.99 including postage. Paying from your bank account adds nothing; paying by card or Apple Pay adds 3% of the gift, which is the card company's charge. The price is shown before you confirm, and prices may change for future gifts with notice on the site.
- Scheduled gifts. You can choose the day a gift arrives. Your payment is taken when you confirm; the card and the money are released that morning (US Eastern time).
- Bank payments. A gift paid from a bank account is delivered once the transfer clears, usually within a few business days. If your bank declines it, nothing is charged and the gift is not sent.
- The recipient's details. You confirm that you have the right to give us the recipient's name and email address or mobile number, that they would welcome your gift, and that you'll give us a mailing address only for a card they'd want to receive.
- Mistakes. Check the recipient's details before you confirm. Once a gift has been claimed it cannot be reversed. If a gift hasn't been claimed yet, email us and we'll do our best to correct or cancel it.
4. Receiving and claiming a gift
- A gift is yours to claim from the link we send you (or the link printed inside a mailed card). To claim it you open a Stripe Express account under your own name and connect a bank account. Standard payouts arrive in 1–2 business days; receiving is free.
- If a gift reached you by text message, we'll ask for your email address when you claim it, because Stripe needs one to pay you and send your transfer receipt.
- Unclaimed gifts. We'll remind you about a gift you haven't claimed. If a gift is still unclaimed after 30 days, the money is returned to the sender, and the sender may ask us to return it sooner at any time before it's claimed.
- The link to your gift is private: anyone with it can open the card. Don't forward it.
5. Group gifts, events and registries
- Group gifts. The organizer starts a collection and shares a link. Contributions are paid to Stripe and sent on to the recipient as one gift when the organizer sends it; the organizer pays only for the card. A contribution that clears after the gift was sent is refunded in full. The organizer is responsible for sending the gift to the person it was collected for.
- Events and registries. A host sets up an event, connects a Stripe Express account, and shares a link or QR code. Guests' gifts go directly to the host's account; nvlope keeps only the card price and card-processing pass-through. Hosts are responsible for the accuracy of their event page and for how they use the funds. The Host kit (registry, who-gave list, custom link and QR code, thank-you cards with your logo) is free for every host.
6. Cards, thank-yous and your content
You own what you put on a card: your words, handwriting, photos, logos, video and voice. You give nvlope a license to store, display, print and deliver that content to the people you address it to, and to the people who chip in to a group gift, for as long as the card is kept in nvlope. Only use content you have the right to use. We may remove content that is unlawful, hateful, harassing or that infringes someone's rights, and we may decline to print or deliver a card for the same reasons.
Thank-you cards are free to send digitally; a printed, mailed thank-you is $4.99 including postage. Every card you receive is kept in your keepsake album; during early access every card is kept free of charge.
7. Accounts
You don't need an account to send, receive or chip in. An account (sign in with your email or mobile number; no password) keeps everything you've sent and received in one place. You're responsible for keeping the email address and phone number on your account under your control; anyone who can open your sign-in link or receive your sign-in code can get into your account. Tell us at once if you think that's happened.
8. Text messages
nvlope sends text messages only when someone asks for them: a one-time message to a recipient whose mobile number a sender entered, with the link to their gift; a request for a mailing address when a sender chose a printed card; a sign-in code you requested; and reminders you set up yourself. Message frequency varies with your use; typically one message per gift. Message and data rates may apply. Reply STOP to any message to stop receiving texts from nvlope, and HELP for help, or email info@nvlope.com. Carriers are not liable for delayed or undelivered messages. Your mobile number is used only as described in our Privacy Policy; it is never shared with third parties or affiliates for marketing or promotional purposes.
9. Acceptable use
Use nvlope for personal gifts, celebrations and thank-yous between people who know each other. Don't use it to sell goods or services, to pay or collect debts, for gambling, for anything illegal, or to send money to or on behalf of someone who hasn't consented. Don't send cards to people who've asked not to hear from you. Don't try to break into, overload or reverse-engineer the Service, or use it with false information. We may suspend or close accounts, cancel gifts and refuse service when these rules are broken or when Stripe or the law requires it.
10. Refunds and problems
Card prices and fees are non-refundable once a card has been delivered or printed. If something goes wrong on our side — a card that never arrived, a gift that couldn't be claimed because of a fault in the Service — email us and we'll put it right, which may include a refund. Disputes about a gift between a sender and a recipient (the wrong person, a change of heart) are between them; we'll help where we can, but a claimed gift cannot be reversed.
11. Early access
nvlope is new. Some features are offered at early-access prices, some are marked "coming soon," and things will change as we learn. We may add, change or withdraw features, and we'll give notice of price changes on the site before they apply to new gifts. Gifts you've already paid for are honored at the price you paid.
12. Disclaimers and limits on our liability
The Service is provided "as is." To the fullest extent the law allows, we make no warranties, express or implied, including that the Service will be uninterrupted or error-free, and we're not responsible for delays or failures caused by banks, card networks, Stripe, carriers, the postal service or anything else outside our reasonable control. To the fullest extent the law allows, Nvlope Technologies, Inc. is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to the Service is limited to the fees you paid us for the gift in question, or $100, whichever is greater. Nothing in these Terms limits liability that can't be limited by law, and some places don't allow some of these limits, in which case they apply to the extent permitted.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules. Before going to court, please email us; most problems can be sorted out in a few days. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court where you live.
14. Changes to these terms
If we change these Terms, we'll post the new version here with a new effective date, and for significant changes we'll email account holders. Continuing to use the Service after a change means you accept it.
